Nothing in these terms excludes or limits rights you may have under the Australian Consumer Law or any other law where those rights cannot lawfully be excluded.

1. About these terms

1.1These terms apply to your use of this website and to services supplied by Rohan's Tutoring, trading as Rohan's GAMSAT, including paid and free educational products, tutoring, mentoring, essay marking, webinars, downloads, and service-related communications.

1.2If you use this website, send us an enquiry, register for a webinar, buy a product, or book a service, you agree to these terms.

1.3A product page, checkout page, booking form, invoice, or written offer may include extra terms about price, inclusions, dates, attendance, access period, or refunds. Those terms also apply to that specific product or service.

1.4If these general terms conflict with the terms for a specific product or service, the more specific terms apply, to the extent the law allows.

2. Services covered

2.1Our services include self paced digital courses, study materials, live classes, workshops, private mentoring, small group tutoring, essay marking, feedback, webinars, downloadable resources, email content, and the contact, registration, and checkout functions on this website.

2.2We provide our services for education and exam preparation. We do not promise any particular score, percentile, admission outcome, scholarship, or interview result.

2.3You must give us accurate and current information when making an enquiry, registering, booking, or purchasing.

2.4If you are under 18, you must have permission from a parent or legal guardian to buy paid services or submit personal information through this website.

3. Pricing and payment

3.1Unless we say otherwise, prices on this website are in Australian dollars (AUD).

3.2We may change prices, inclusions, and offers at any time before you complete a purchase.

3.3Payment must be made through the payment methods we make available at checkout or through another payment arrangement we approve in writing.

3.4We currently use third party payment providers, including Stripe and PayPal. Your payment may also be subject to those providers' own terms and privacy practices.

3.5If a product includes instalments, a deposit, staged billing, or another payment plan, the specific terms shown at checkout or provided to you in writing apply to that arrangement.

3.6We may refuse, cancel, or reverse an order if we reasonably suspect fraud, misuse, a pricing error, unauthorised payment activity, or a breach of these terms.

4. Digital access and account use

4.1Where a product includes digital access, we grant you a personal, revocable, non-exclusive, non-transferable licence to use that content for your own study purposes only.

4.2You must not share login details, distribute purchased materials, reproduce videos or documents, upload course content to public platforms, resell our materials, or allow another person to use access purchased in your name.

4.3Where a product is described as having lifetime access, that means access for as long as we continue to run and maintain that product in substantially the same form.

4.4We may update, replace, reorganise, or retire content when needed, including to fix errors, refresh course material, change delivery systems, or stop offering part of a product.

4.5We may suspend or terminate access if we reasonably believe there has been credential sharing, piracy, abusive conduct, chargeback misuse, or any other material breach of these terms.

5. Live classes, tutoring, mentoring, and webinars

5.1Schedules, tutors, delivery format, cohort dates, and session availability may change because of demand, illness, emergencies, platform issues, or other operational reasons.

5.2Some services are live and time based. If a product page, booking page, or written confirmation sets out attendance rules, cancellation windows, rescheduling limits, or make-up arrangements, those rules apply to that service.

5.3Free webinars and other no-cost events may be changed, postponed, or withdrawn at any time.

5.4Registering for a webinar or free event does not guarantee that future events will continue or that every session will cover the same material.

5.5Unless we say otherwise in writing, turnaround times for essay marking, email replies, and general support are targets, not fixed deadlines.

6. Refunds, cancellations, and Australian Consumer Law

6.1Any express refund promise, money-back guarantee, or satisfaction guarantee shown on a product page, checkout page, or written offer applies according to the terms of that offer.

6.2For digital products, once access has been granted or materials have been supplied, we generally do not offer refunds for change of mind unless an express guarantee says otherwise or the law requires it.

6.3For live services, tutoring, mentoring, and booked sessions, cancellation and rescheduling terms may differ by product. The specific offer, booking terms, or written confirmation for that service will apply.

6.4Nothing in these terms overrides your rights under the Australian Consumer Law.

6.5If a service we supply fails to meet a consumer guarantee that cannot lawfully be excluded, you may be entitled to a remedy under Australian law.

6.6If you believe there has been a payment error, or you think a service supplied by us has not met the required standard, contact us promptly so we can review the issue.

7. Privacy, forms, and personal information

7.1When you submit a contact form, register for a webinar, join a mailing list, book a service, or make a purchase, we may collect information such as your name, email address, phone number, study background, product interest, payment details, and any other information you choose to give us.

7.2We use that information to respond to you, provide the service you asked for, process payments, send administrative updates, improve our services, and, where you have opted in or where the law allows it, send relevant marketing communications.

7.3We may use third party service providers for payments, form handling, email marketing, analytics, and website operations. Those providers may process information on our behalf under their own terms and privacy practices.

7.4We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where those laws apply.

7.5You can opt out of marketing emails at any time by using the unsubscribe link in the email or by contacting us directly.

8. Intellectual property and acceptable use

8.1Unless we say otherwise, all content on this website and in our products is owned by us or licensed to us. That includes text, teaching frameworks, videos, lesson material, branding, graphics, downloads, prompts, feedback systems, and course structure.

8.2You must not copy, republish, scrape, reverse engineer, sell, sublicense, use commercially, or distribute any part of our content without our prior written permission.

8.3You must not use this website or our services in a way that is unlawful, misleading, abusive, defamatory, discriminatory, disruptive to other students, or harmful to our systems, reputation, or community.

9. Liability and disclaimers

9.1We will provide our services with due care and skill.

9.2To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from your use of the website or services, including loss connected with exam outcomes, missed opportunities, internet outages, third party platform failures, or reliance on general educational material without applying your own judgment.

9.3We do not promise that the website will always be uninterrupted, error free, or compatible with every device, browser, or third party service.

9.4Nothing in these terms excludes any liability that cannot lawfully be excluded, including rights and remedies available under the Australian Consumer Law.

10. Changes to services and these terms

10.1We may update this website, our offers, and these terms from time to time.

10.2The version published on this page is the current version. Changes take effect when they are published unless we say a later date applies.

10.3If you continue using the website or our services after updated terms are published, that continued use means you accept the updated terms.
